TERMS OF USE You should carefully read the following Quest Constitution agreement before creating an account (on the game server or message board) or installing this software program. By installing, copying, or otherwise using the software program or creating an account (on the game server or message board), you agree to be bound by the terms of this agreement. To summarize, you consent to the Quest Constitution if: a) You create an account on the Quest Master Server b) You connect to the Quest Master Server c) You create an account on the Official Quest Message Board d) You post to the Official Quest Message Board You further agree that these rules will apply to anyone that you allow to use your Quest accounts(s) or message board ID, and that you are personally responsible for the consequences (including termination of your access to the servers) that may result if any such person breaks these rules. Also, Quest and Quest Staff will not be responsible for any damage that should happen if someone else uses your account. If your account is somehow hi-jacked we are not responsible. You need to choose a more secure password. You acknowledge that if your Quest or Official Quest Message Board accounts are terminated for any reason, you do not have the right to damage any property or do any harmful activities to the Quest Staff and/or players. The Quest Constitution is a living document. It can change at any time. You are responsible for being aware of any Constitution changes. II. TERMS AND CONDITIONS You may not harass, threaten, cause distress or unwanted attention or discomfort to another player. This excludes Player Killing, which is accepted in Quest. You may not use any excessively offensive or sexually explicit language. You may not use any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable language toward any other player. You may not impersonate any of the Quest Staff or anyone from the Quest Community (Quest, Official Quest Website, Official Quest Message Board) at any time. You may not use anything from Quest(software, graphics, text) without the written consent of a Quest Developer. You may not modify or attempt to modify any part of the Official Quest Website, Quest Server, or Official Quest Message Board. You may not organize any guilds, groups, or clans that are based on, or expose, any racist, sexist, anti- religious, anti-ethnic, anti-gay, or other hate-mongering philosophy. You may not use the Quest Server for any other purpose other than that expected in the game, this being chatting or playing. You may not post or communicate any player's real world personal information within the Quest Server, Official Quest Website, or Official Quest Message Board without consent from that person. You may not give false information or intentionally hide any information that is required at the time you make a Quest account. You will not upload, transmit, or spread any copyrighted material on the Official Quest Message Board or Quest Server. You may not modify or replace any electronic information being exchanged by the Quest Client or Server. You only have the right to modify: a) The config.ini file that is generated by the client.exe b) You may modify the optional Quest Monster Pack in however you see fit Any other modifications require written consent from a Quest Developer. You are not entitled to any type of refund if your account is lost/terminated, in game items are lost, or your Official Quest Message Board account is lost/terminated. It is strictly forbidden to use an application or programmatic means to artificially provide input in the Quest client. This includes, but is not limited to: macros, mouse clicks, mouse movement, keyboard input, artificial input from any port (serial, parallel, USB, firewire, SCSI, etc.), tape, or any weighted object placed on a key to provide rapid or steady input, clock modifying applications (accelerators, "speedhackers", etc.), packet sniffers/injectors, memory editors and bubblegum. Using any artificial input methods will result in the termination of your account and possibly the blocking of your machine to prevent you from using the service completely. You are not entitled to any type of refund because of Quest Server, Official Quest Website, or Official Quest Message Board downtime. You agree to the fact that your account can be deleted at any time for inactivity. The length of inactivity is determined by the Quest Developers. If an account has been transferred from the original owner to another person, this voids all support from Quest and Quest Staff. Quest does not guarantee that you will be free from the behavior of others the you may deem obscene, harassing, insulting, or offensive while you are playing Quest or on the Official Quest Website or Official Quest Message Board. Quest Staff reserves the right to take action against such behavior, or not to pursue the complaint whatsoever. III. APPEALS You have the right to appeal if: a) You think your account has wrongfully be banned b) You have been wrongfully persecuted You may write up your appeal in the Appeals forum of the Official Quest Message Board. The Quest Council will then decide whether or not to unban your account. IV. GRIEVANCES If you suspect that a player (regular user or Quest Operator or Quest Master Operator) is breaking any rules in the Quest Constitution then you have the right to report it. You may file a grievance in the Grievances forum of the Official Quest Message Board. If the grievance is proved to be accurate then that user will be dealt with according to the Constitution Violations section below. V. PRIVACY POLICY All information collected by Quest, the Official Quest Website, and the Official Quest Message Board are kept private. No third parties will be granted access to any of this information. The Quest Council (Quest Master Operators) may request this information and be granted access to it. If for any reason, collected information is to be released to a third party, an attempt will be made to notify the proper users in advance. VI. CONSTITUTION VIOLATONS If you violate the Quest Constitution in any way, then any or all of the following could rightfully happen to you and your mother: a) Your Quest account can be terminated without warning b) Your Quest account can be temporarily disabled c) Your Official Quest Message Board account can be terminated without warning d) Your Official Quest Message Board account can be temporarily disabled e) You can be banned from the Quest Master Server f) You can be banned/blocked from the Official Quest Website and the Official Quest Message Board g) Quest Developers have the right to sue your ass
